The expansive view of presidential power known as the unitary executive, which is the Chief Justice John Roberts’ theory, is a complete bullshit.
Increasing the power of the presidency by giving Trump the right to fire almost everyone as he want, is against the separation of powers. He firedthem despite the court’s 1935 decision in Humphrey’s Executor case that prohibits the president from removing the heads of independent agencies without cause.
The Federal Trade Commission, the National Labor Relations Board, the Merit Systems Protection Board, the Consumer Product Safety Commission and last but not least the Federal Reserve (Lisa Cook is still in office but for how long?) : all these agencies are contributing to rule the american economy.
The separation of powers between the legislative branch, the executtive branch and the judiciary is endangered by this theory. But it is the separation between political and economic powers that is also threatened.
The more absolute this power becomes in Trump’s hands, the more foolish economic measures he will take. He can continue to raise tariffs without managing to curb inflation. He can fail to cool down the AI market, but when the bubble bursts, wiping out all the retirement savings of the American people, the catastrophe will be blamed on a single man.
And then, as the British (Charles Ist january 30, 1649) and the French (Louis XVI, january 21st, 1793) did with their unitary excutive monarchs, the head of the king Donald 1st will have to be cut off.
